These Terms of Service (“Terms”) govern your access to and use of the Jouzu mobile application and related services (collectively, the “Service”) operated by RoleGaku, Inc. (“RoleGaku,” “Jouzu,” “we,” “our,” or “us”). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
You must be at least 13 years old to use the Service. If the laws in your country require a higher minimum age for you to consent to the processing of your personal data, you must meet that higher age requirement or have valid permission from a parent or legal guardian as required by applicable law.
By using the Service, you represent and warrant that you meet the applicable eligibility requirements and that you are legally able to enter into these Terms. If you are using the Service on behalf of a company, school, or other organization, you represent and warrant that you have the authority to bind that organization to these Terms.
Jouzu is a language learning service that provides features including, without limitation, AI-powered chat, text input, speech input, text responses, speech responses, pronunciation-related features, sentence inspection tools, flashcard creation, and other language learning features that may be added, removed, or modified from time to time.
The Service is intended to provide language learning assistance and educational support. The Service may evolve over time, and we reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, to the fullest extent permitted by law.
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your information updated.
You are responsible for safeguarding your login credentials and for all activities that occur under your account. You must promptly notify us at support@rolegaku.com if you believe your account has been accessed without authorization or otherwise compromised.
You may not share your account with another person, impersonate another person, or create an account using false or misleading information.
You agree to use the Service only in compliance with these Terms and all applicable laws, rules, and regulations. You may not use the Service in any manner that could harm the Service, other users, or third parties.
Without limiting the foregoing, you agree that you will not, and will not attempt to:
use the Service for unlawful, fraudulent, harmful, abusive, harassing, threatening, defamatory, obscene, or otherwise objectionable purposes; submit content that infringes or violates the rights of any person or entity; interfere with or disrupt the integrity or performance of the Service; probe, scan, or test the vulnerability of the Service or any related system or network; access or use the Service through unauthorized automated means; reverse engineer, decompile, disassemble, copy, modify, or create derivative works of the Service except to the extent such restriction is prohibited by law; exploit bugs, errors, or vulnerabilities in the Service; attempt to bypass security measures or access controls; use the Service to develop or improve a competing product or service; or engage in behavior that we determine, in our sole discretion, is toxic, abusive, harmful, or intended to misuse the Service.
Jouzu uses artificial intelligence systems to generate responses, explanations, language learning assistance, pronunciation-related outputs, and other content.
Artificial intelligence systems may produce content that is inaccurate, incomplete, misleading, outdated, offensive, or otherwise incorrect. AI-generated content may not always reflect correct linguistic usage, appropriate educational methods, or accepted best practices. The Service may make mistakes, and different users may receive different outputs in response to similar inputs.
The Service is provided for language learning assistance and educational support only. AI-generated responses should not be relied upon as the sole source of language instruction, educational evaluation, factual verification, or professional advice of any kind. You are responsible for evaluating any output before relying on it, and you acknowledge that you use AI-generated content at your own discretion and risk.
The Service may allow you to submit, upload, transmit, create, store, or otherwise make available content, including text, chat messages, audio recordings, flashcards, lesson responses, and other materials (“User Content”).
As between you and RoleGaku, and subject to applicable law, you retain ownership of your User Content. However, by submitting or making available any User Content through the Service, you grant RoleGaku and its affiliates, service providers, contractors, and partners a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, adapt, process, analyze, publish, transmit, display, perform, and otherwise use that User Content for the purposes of operating, providing, maintaining, securing, moderating, improving, and developing the Service and related technologies, including machine learning, speech recognition, pronunciation analysis, and artificial intelligence systems.
You represent and warrant that you have all rights necessary to submit the User Content and to grant the rights and licenses described in these Terms, and that your User Content and our use of it as permitted by these Terms will not violate any law or infringe, misappropriate, or otherwise violate any right of any person or entity.
We may monitor, review, analyze, flag, or moderate use of the Service and User Content for purposes including quality assurance, feature improvement, abuse detection, safety, policy enforcement, fraud prevention, legal compliance, and account moderation.
You acknowledge and agree that certain User Content, including chat content and audio content, may be reviewed by authorized human personnel for quality, safety, moderation, and service improvement purposes.
We reserve the right, but do not undertake the obligation, to remove, restrict, or refuse any User Content or suspend or terminate any account at any time, with or without notice, if we believe that the content or conduct violates these Terms, poses risk to the Service or others, or is otherwise objectionable.
You acknowledge and agree that User Content, including text conversations, audio recordings, pronunciation data, speech patterns, and other interactions with the Service, may be used to improve Jouzu’s machine learning systems and related technologies.
This may include improving language learning algorithms, speech recognition systems, pronunciation analysis systems, and AI language models used within the Service. Such use may involve automated processing and, where appropriate, human review by authorized personnel.
You should not submit sensitive personal information through the Service. This includes, by way of example, passwords, payment card details, bank account information, government identification numbers, health information, biometric identifiers used for identity verification, or other highly sensitive personal data.
If you choose to submit sensitive information despite this warning, you do so at your own risk, subject to applicable law.
The Service may offer paid features, digital goods, subscriptions, or other in-app purchases. Purchases made through Apple’s App Store or Google Play are processed by the applicable platform provider and are subject to that provider’s terms, conditions, and policies in addition to these Terms.
Unless otherwise required by applicable law, all purchases are final and non-refundable. RoleGaku does not control the billing practices of Apple or Google and is not responsible for payment processing errors, declined payments, chargebacks, platform-level subscription management, or other billing matters handled by those platform providers.
We may change prices, paid features, or monetization models at any time, subject to applicable law and platform requirements.
We do not guarantee that use of the Service will result in any particular language learning outcome, level of proficiency, test performance, academic result, or educational benefit. Individual results may vary significantly depending on many factors outside our control.
RoleGaku does not guarantee that the Service will be available at all times or without interruption, delay, or error.
The Service may experience outages, delays, maintenance periods, technical issues, third-party failures, platform interruptions, network disruptions, data loss events, or other problems. Features may be changed, suspended, or discontinued without notice.
To the fullest extent permitted by law, RoleGaku is not responsible for any loss of data, learning progress, business opportunity, goodwill, or other damages arising from service interruptions, unavailability, delays, technical failures, or the modification or discontinuation of any part of the Service.
The Service may rely on or interoperate with third-party services, infrastructure, APIs, app stores, hosting providers, analytics providers, payment processors, and other partners. Your use of such third-party services may be subject to their own terms and privacy policies.
We are not responsible for the availability, security, accuracy, legality, or practices of third-party services, and use of them is at your own risk.
The Service, including all software, technology, design, text, graphics, interfaces, trademarks, service marks, logos, compilations, and other content provided by or on behalf of RoleGaku, and all intellectual property rights therein, are owned by or licensed to RoleGaku and are protected by applicable intellectual property and other laws.
Subject to your compliance with these Terms, RoleGaku grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, educational, classroom, or internal business use as permitted by the Service and these Terms.
No rights are granted to you except as expressly stated in these Terms.
If you provide suggestions, ideas, improvements, recommendations, bug reports, or other feedback relating to the Service (“Feedback”), you grant RoleGaku a worldwide, perpetual, irrevocable, royalty-free, fully paid, transferable, sublicensable right to use, reproduce, modify, distribute, display, perform, and otherwise exploit such Feedback for any purpose without restriction or compensation to you.
We may suspend, restrict, disable, or terminate your access to the Service, in whole or in part, at any time, with or without notice, if we believe that you have violated these Terms, created risk or possible legal exposure for us or others, engaged in abusive or harmful conduct, or for any other reason in our sole discretion, to the fullest extent permitted by law.
You may stop using the Service at any time. You may request deletion of your account and associated data through the deletion process made available at https://jouzu.ai/delete-data-request or by contacting support@rolegaku.com, subject to our legal obligations and legitimate retention needs.
Termination or suspension does not limit any of our other rights or remedies.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. ROLEGAKU DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, ROLEGAKU DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, ACCURATE, RELIABLE, COMPLETE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT WILL BE CORRECT OR SUITABLE FOR YOUR NEEDS.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ROLEGAKU, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF ROLEGAKU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ROLEGAKU FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50.00).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED BY LAW.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless RoleGaku, its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, actions, proceedings, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any law or the rights of any person or entity; or (e) any fraud, negligence, or willful misconduct by you.
Please read this section carefully because it requires you and RoleGaku to resolve most disputes through binding individual arbitration and limits the manner in which you can seek relief from us.
To the fullest extent permitted by law, you and RoleGaku agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or the relationship between you and RoleGaku, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, will be resolved by final and binding arbitration on an individual basis, except that either party may bring an individual action in small claims court if the claim qualifies.
You and RoleGaku agree that class actions, class arbitrations, representative actions, and private attorney general actions are not permitted. You may bring claims against RoleGaku only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
The arbitration will be administered by a recognized arbitration provider selected by RoleGaku, under the provider’s applicable consumer arbitration rules as modified by these Terms. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, except that a court of competent jurisdiction shall determine issues relating to the enforceability of the class action waiver.
If any part of this arbitration section is found unenforceable as to a particular claim or remedy, then that claim or remedy shall be severed and litigated in court, and the remaining claims shall be arbitrated.
These Terms and any dispute arising out of or relating to these Terms or the Service will be governed by the laws of the State of Delaware, without regard to its conflict of laws principles, except to the extent superseded by applicable federal law or otherwise required by applicable consumer protection law.
The Service is operated from the United States and may be made available internationally. We make no representation that the Service is appropriate or available for use in every jurisdiction. You are solely responsible for complying with the laws applicable to you in the jurisdiction from which you access or use the Service.
We may modify these Terms from time to time. If we make changes, we will update the “Last Updated” date above and may provide additional notice as required by law. By continuing to use the Service after the updated Terms become effective, you agree to be bound by the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
These Terms constitute the entire agreement between you and RoleGaku regarding the Service and supersede all prior or contemporaneous agreements, understandings, and communications relating to the Service.
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
Our failure to enforce any provision of these Terms will not be deemed a waiver of that provision or any other provision.
You may not assign or transfer these Terms or any rights or obligations under these Terms without our prior written consent. We may assign these Terms, in whole or in part, at any time without restriction.
